Securing the Future: Why a Trust Fund is essential for a loved one with a learning disability

For many parents of children with learning disabilities, the question of "what happens when I’m no longer here?" is a constant source of anxiety. In a moving short film by Mencap, a mother named Carol shares how setting up a trust fund for her 53-year-old son, David, allowed her to finally find peace of mind.

The motivation for action

Carol describes the realization that time moves quickly - noting that David is already in his fifties. Her primary motivation for setting up the trust in 2015 was the unpredictable nature of life. "You’re not getting any younger," she explains, "you know that you could be gone tomorrow". By putting a formal structure in place, she ensured that David would be looked after long after she is gone.

The risks of direct inheritance

While many parents naturally want to leave money directly to their children, Mencap representative Alison highlights the significant risks associated with this approach. Inheriting money directly can lead to:

  • Loss of Benefits: Large sums of money can disqualify individuals from essential means-tested benefits.
  • Care Contributions: Inherited funds might be consumed by care costs that would otherwise be covered.
  • Financial Abuse : Leaving a vulnerable person with a direct inheritance can unfortunately leave them open to exploitation.

The Support System

Carol emphasizes that while the process of thinking about the future can be "scary," the support she received from Mencap was invaluable. She specifically praises Alison for being "down to earth" and "understanding," noting that the level of support provided was "unbelievable". Having experts to answer complex questions made a daunting legal process manageable.

A Message to Other Parents

Carol’s message to other families is clear: do not wait. Despite the emotional difficulty of planning for a time when you are no longer around, she insists that it is "worth it".

"I’m glad that it was done and dusted," Carol says. "I can relax more now". For her, the trust fund isn't just about money; it’s about the freedom to enjoy the present, knowing the future is secure.
